In order to participate in inflatable course access, soft play access, café access and any other amusement and/or entertainment activities , (collectively herein called “Activities”) organised by KIDS COMPLEX, owners, officers, directors, volunteers, participants, clients, customers, invitees, employees, independent contractors, insurers, facility operators, land and/or premises owners and any and all other persons and entities acting in any capacity on its behalf (collectively KIDS COMPLEX” also known as “the Company”), I agree as follows: Find the rules of play for the inflatable course: Users must not wear shoes on the structures, but they must wear socks. We advise against the use of grip socks due to risk of injury on slides. Users must remove all jewellery, eyewear (where possible), watches, hard objects and other metallic objects that may cause tears or injury to themselves or other users. Children must not play in a boisterous manner that is likely to cause harm to themselves or others. Users must not pull or swing on the tethering ropes, nor attempt to lift or distort the structure or attempt to dislodge other users in any way. Users must not climb on or hang onto the outside walls of the structure or any other part of the structure, unless it is a specific activity designed specifically for that purpose – for example, climbing up to slides. Users must not be allowed to bounce on the front step of the structure, to enable safe, clear and controlled access and egress for the other users. Adults must not use the structure for play purposes and are only allowed on for the purpose of child supervision. Users are instructed not to perform somersaults, flips or any other kind of acrobatics that may injure themselves or others. Users should pay attention to and always follow instructions from any supervisors. Find the rules of play for the soft play frame: Kids should have long sleeves tops, full length bottoms and socks on at all times. Socks can be purchased at reception. Under 4s are not allowed on the big play frame and main inflatables without adult supervision. Children aged 4 & over are not permitted in the toddler area and toddler inflatables at any time. Adults are not allowed on the volcano. Children must not run up slides. No food or drinks allowed on any play equipment. No climbing on the structure nets. Rules when visiting Kids Complex in general: Disrespectful behaviour towards Kids Complex staff will not be tolerated. Our staff have the right to ask children or adults who are not adhering to any rules to leave the premises immediately with no refund. All kids should be always supervised by an adult 18 years of age or over. Adults are solely responsible for supervising their children and this is not the responsibility of Kids Complex staff. NO photography of any kind permitted. Strictly no food or drink to be brought into or consumed on premises, there will be no exceptions made for this. No jewellery to be worn on any play equipment. Smoking and vaping is not permitted inside the premises. Strictly no adults under the influence of alcohol or drugs inside the premises - entirely at staff discretion. Children with contagious illnesses should not enter the premises. Kids Complex have the right to refuse entrance entirely at staff discretion. If you have issues with other visitors, please raise them with a member of staff. Do not try to resolve them yourself as this can result in further conflict. Kids Complex is not responsible for any lost or damaged items. I agree that I/minors in my care will undertake the activities in accordance with the written safety rules and advice that are aforementioned in this waiver and any oral instructions or advice given to me prior to or during the session by an Employee of KIDS COMPLEX I/minors in my care agree to wear any safety equipment and/or clothing required by KIDS COMPLEX in accordance with their safety instructions and that I/they will follow the directives of KIDS COMPLEX, its management and staff at all times. I acknowledge that I am responsible for my own safety/the safety & supervision of the minors listed (and the safety of our possessions) and that KIDS COMPLEX do not provide any supervision of children whilst using the premises or children attending unaccompanied or if left unaccompanied on the premises. I acknowledge that only children aged 13 years & under can be paid into the centre and allowed to play on the soft play and inflatables equipment. No individuals aged 14 & over are allowed on any equipment for the purpose of playing. Individuals aged 16 & over may go on the equipment for the purposes of supervision of minors only. I hereby confirm that I am / minors in my care are in good physical condition and do not suffer from any disabilities or physical conditions that place me / them or others at risk or otherwise should prohibit mine or their safe participation in the activity. (if in any doubt, please check with the children’s parent or guardian). I acknowledge the following contra-indications to safe jumping on medical grounds and certify that I/minors in my care have no pre-existing medical conditions which, could through participation in the Activities, result in injury to myself/themselves or damage to my health: Contraindications to participation:- • Excessive participant weight > 110kg/17.3 stone • Circulatory conditions • Heart or lung conditions • Recent surgery • Back or neck conditions (including Rodded back and Brittle bones) • Muscle or joint conditions • High blood pressure • Spine, musculoskeletal or head injury • Achondroplasia (disproportionate Dwarfism) • Pregnancy • Uncontrolled Epilepsy Down's Syndrome - Customers with Down Syndrome, prior to taking part in such activities, must obtain evidence that a GP or Paediatrician has screened them using the screening test developed by the British Gymnastics Association for Atlanto-Axial Instability. Approval for participation that is signed by the GP or Paediatrician must be provided before taking part in any soft play or inflatable activities. If in any doubt as to your ability to participate safely in the Activities, please seek advice from your GP. YOUR ACKNOWLEDGMENT I understand that Kids Complex do not assess the abilities of individual participants or the suitability of the Activities for use by individual participants. I further understand that all participants, parents and guardians must make their own assessment of whether the Activities are suitable for use by individual participants and individual participants ability to participate in the Activities prior to use. I understand that the Activities are used by multiple age groups at the same time and caution must be used. The toddler soft play area and the toddler inflatables area are exclusively for children aged 3 & under – no other children may play in these areas. I understand that the Activities are physically demanding and involve jumping and other strenuous actions sometimes involving height, speed, and unpredictable surfaces. I understand that the Activities are a high-impact, full body activity which requires intense focus, awareness of my body’s strengths and limitations, awareness of the environment around me, and extreme caution at all times. I understand that my participation in the activities provided by KIDS COMPLEX entails known and unknown risks that could result in physical or emotional injury, paralysis, death or damage to myself, to my property or to third parties I/minors in my care use the Activities entirely at my/their own risk. I understand that participation in the Activities can result in personal injury including, but not limited to, friction burns, cuts, abrasions, bruising, muscle strains, twists, sprains, dislocation, broken bones and paralysis and accept that these injuries can occur through general use of the equipment and not always or necessarily as a result of defective equipment or negligence of the Company. I understand and accept that the Activities require a moderate level of fitness and can be physically demanding and require physical effort and I/they should not undertake the Activities unless I/they am(is/are) physically able to. I understand that I am/they are responsible for my/their own actions and or involvement in using the Activities. I understand that I am/they are not permitted to hold/cradle babies and/or small children whilst using any of the Activities, as this may result in severe injury to both parties. I understand that KIDS COMPLEX do not provide direct supervision of participants when using the Activities. I understand that KIDS COMPLEX do not provide training or tuition to participants in the use of the Activities. I understand that KIDS COMPLEX do not assess any participant’s skill levels, abilities, competency or the suitability of the Activities for use by them. I understand that use of the Activities requires at minimum, a basic athletic and jumping ability. I/they will not attempt flips or other airborne moves/manoeuvres due to the risk it poses to other activity users. In the unlikely event of an accident, or loss or damage to any personal effects, I acknowledge that the Company will not be liable for any direct or indirect loss, damage or injury arising from or in connection with the Activities (except for death or personal injury caused by the Company’s negligence), or with my/our failure to comply with the safety instructions and/or directions of KIDS COMPLEX and I waive all and any claims against the Company in this respect. I hereby grant, KIDS COMPLEX, on behalf of myself and the minors in my care the irrevocable right and permission to photograph and/or recording for all purposes, including advertising and promotional purposes. I waive any right to inspect or approve the use of the photograph and/or recording and acknowledge and agree that the rights granted to this release are without compensation of any kind. I acknowledge that CCTV images of all entrants will be monitored and recorded throughout the premises for the purpose of public safety and crime prevention. I accept that CCTV may be recorded and retained indefinitely in any instances that KIDS COMPLEX management deem appropriate to do so. I acknowledge that I have read and fully understand the above prior to my signing below and I confirm acceptance of KIDS COMPLEX Rules and all terms and conditions. I confirm that I am/minors in my care are not under the influence of drugs or alcohol and accept that participants cannot take part in any Activities having consumed any alcohol or drugs prior to attending. I hereby consent for myself and any minors in my care to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during any play sessions without need for further verbal approval. I acknowledge that I (and the minors in my care if applicable) have been provided with safety rules and advice of the Company in relation to the Activities and that I have read and fully understand the above and accept the terms of participation freely and voluntarily without any inducement prior to signing/submitting this form. *

Fienta's terms of service for the ticket buyer

Fienta Ticketing OÜ, (henceforth Fienta), registry code 12658162, address Hobujaama 4, Tallinn 10151, e-mail [email protected].

When visiting and using the Fienta web platform (henceforth e-ticket shop), the following terms of service (henceforth terms of service) apply to the user of the e-ticket shop (henceforth Buyer):

Service and tickets
1. The Buyers can buy tickets from the e-ticket shop, which have been added to the e-ticket shop by the organiser of the event (henceforth Organiser).
2. Fienta sells tickets at the request, in the name of and at the expense of the Organiser, and does not have the right to implement or change the ticket price or the Organiser’s terms of sale, including buying back tickets or exchanging tickets, compensating for destroyed, lost, stolen or damaged tickets or any other objects related to the event. Fienta is not the Organiser of any of the events.
3. To purchase tickets, the Buyer should select the class of ticket and amounts, and enter the required information, which may vary across events.
4. The Buyer will receive the purchased e-tickets via e-mail immediately after making the payment in their internet bank, by credit card or as a transfer based on an invoice.
5. When purchasing tickets at a reduced price, Fienta does not verify whether the Buyer fulfils the necessary conditions for receiving the reduced price. Purchasing a ticket at a reduced price does not guarantee entrance to the event, and whether the reduced price applies to the person entering with that ticket will be checked on location at the event venue.
Fienta’s rights and obligations
1. If the Buyer enters false information, Fienta has the right to block their purchasing rights.
2. If these terms of service are violated, Fienta has the right to unilaterally cease the use of the e-ticket shop for that Buyer and/or terminate the ticket purchasing process.
3. Fienta has the right to use personal data as outlined in the privacy policy.
The Buyer’s rights and responsibilities
1. The Buyer has the right to purchase tickets through the e-ticket shop according to the terms of service. In case of violations of these terms, Fienta has the right to limit that right.
2. By carrying out any transactions on the e-ticket shop website, the Buyer confirms that:
  1. he or she is at least 18 years old, a natural person with active legal capacity (natural persons of limited legal capacity aged 7-18 confirm respectively that they have the consent of their legal guardian for using the e-ticket shop, who has provided them with the means to purchase the ticket) or that they are a legal person, whose representative has all rights to use the e-ticket shop on behalf of the legal person and to take on obligations on behalf of that legal person;
  2. he or she fulfils all the terms of service of the e-ticket shop;
  3. he or she has disclosed only correct information;
  4. he or she ensures the confidentiality of their user name and password.
Intellectual property rights
1. All the text, graphics, edited content, all information, all layouts, all drawings, images, HTML, appearance and feel, photos, music, sounds, images, software, videos, design, font and other content (henceforth: material protected by rights) that the users see or read when using the platform (except for the content created by the users that Fienta has the right to use) is the property of Fienta or the Organiser of the event. Material protected by rights is protected in all forms, on all information carriers, and in all existing and future technological solutions. Material protected by rights is protected under local and international copyright and patent laws, as well as other rights and laws pertaining to assets. Users cannot copy, download, use, redesign, reformat or reproduce any of the materials from the platform without the prior written expressed consent from the owner. Using material protected by rights (except if authorised in the terms of service) without Fienta’s permission and/or (if applicable) without the authorisation of the owner of the content created by the user is prohibited.
2. Fienta service marks and trademarks (including the name Fienta and Fienta logos) are service marks that belong to Fienta. Other trademarks, service marks, logos and/or trade names that are disclosed through the platform belong to their owners. You cannot copy or use these trademarks, logos or trade names without the written expressed consent of their owners.
Personal data
1. Questions pertaining to the processing of personal data have been regulated by the privacy policies of Fienta and the Organiser, as well as the applicable legal acts.
Liability
1. All rights and obligations related to the tickets are enforced by and notified of by the Organiser and Fienta is not liable for the content, change or fulfilment of these rights and obligations.
2. Fienta is not a representative of the responsible party for the Organiser’s or artist’s event taking place, its contents, information, advertisement and quality. The responsible party is the Organiser.
3. Fienta is not liable for a delay in the delivery of the ticket, which has been caused by the user of the e-ticket shop entering incorrect information, by the actions of third parties, by interruptions to the internet connection between the e-ticket shop and the client, as well as by any other circumstance beyond Fienta’s control.
4. If the event does not take place, if it is postponed or if its location is changed, Fienta is not obligated to buy back or compensate the tickets. The Organiser is responsible for either buying back or compensating the tickets.
Final provisions
1. Fienta reserves the right to change their terms of service by publishing a new redaction on the Fienta website.
2. The usage of the e-ticket shop is subject to the laws of the Republic of Estonia.
3. Disputes arising from using the e-ticket website will be resolved in the Harju County Court according to these terms of service and the laws of the Republic of Estonia. The Buyer, who is a consumer, also has the right to turn to the Consumer Disputes Committee.
